BBC presenters under investigation regarding IR35 status

More than 100 BBC presenters are under investigation for IR35 status and whether they should pay tax as employees rather than self-employed.  BBC newsreaders Tim Willcox and Joanna Gosling are currently defending HMRC’s charge that they are inside IR35 legislation.  Proceedings at the tribunal last week note the importance of how the working practices actually operated in reality rather than how they were intended to operate.  Therefore, it is clear that the specific facts of each case will be considered rather than a generic view taken.  The BBC claims that HMRC has indicated an intention to initiate IR35 proceedings with presenters at other broadcasting organisations.
